Privacy Policy, Terms and Conditions, and End-User License Agreement
Thank you for joining Medistry. We at Medistry Technologies Private Limited ("Medistry", "we", "us") respect your privacy and want you to understand how we collect, use, and share data about you. This Privacy Policy covers our data collection practices and describes your rights regarding your personal data.
This Privacy Policy applies when your information has been added on our websites, mobile applications, or related services (the "Services"). It also applies to prospective and current customers of our business and enterprise products, their users, and their clients.
By using the Services, you agree to the terms of this Privacy Policy. You shouldn't use the Services if you don't agree with this Privacy Policy or any other agreement that governs your use of the Services including the End User License Agreement.
The hospital, clinic, or independent private practitioner that has purchased the Medistry application.
A doctor or any staff member who has been added to the subscriber's team on the Medistry application. This includes nurses, secretary, technical staff or anyone the subscriber chooses to provide access to.
A registered and qualified medical practitioner (doctor) registered with the appropriate government body authorised to practice in India.
Name, professional designation, clinic or hospital name, contact number, email address, registration or license number, and other similar information you provide while registering or interacting with our Services.
Information related to your interactions with our Services, such as IP addresses, browser type, device type, operating system, pages visited, actions taken within the application, timestamps of actions, and related diagnostic logs used for security monitoring and enhancing service performance.
When you create an account, you provide us with your name, phone number, email, business information, services you provide, and doctor details. This information is used to enrol you in our services, manage your account, provide customer support, process billing, maintain security, communicate with you, respond to legal requests, and improve our services.
When you subscribe, we collect data including the purchased plan, expiry date, number of doctors and support staff, and the invoice ID generated by Razorpay. Medistry does not store any card details, UPI IDs, or net banking credentials.
When you use features such as report creation, voice-to-text, or upload documents, we may collect health information, medical records, patient reports, and related data. Medistry does not sell, license, or monetise user-uploaded medical reports to third parties.
Automatically collected data includes device operating systems, usage metrics, system events, cookies, IP address, browser type, geolocation, page views, and in-app actions. This is used to improve services, enhance security, diagnose issues, and ensure compliance.
Medistry only collects personal and sensitive personal data that is lawful, relevant, and strictly necessary for providing our Services. We follow the principle of data minimisation.
By registering for and using Medistry's Services, you explicitly consent to the collection, processing, and use of your personal data as described in this Privacy Policy. Your electronic acceptance constitutes valid consent under applicable Indian laws.
As a healthcare provider and Data Fiduciary under applicable Indian laws, you must inform each patient that their personal data will be collected, stored, and processed on Medistry's platform, and obtain explicit, valid consent from each patient before uploading their data.
Medistry may share your personal data with select third-party service providers strictly to fulfill our services:
All third-party providers are bound by contractual obligations restricting data processing solely to stated purposes. Medistry will never publicly disclose, sell, or trade your personal data or SPDI.
Medistry primarily stores data on servers in India. Limited cross-border transfers occur when using OpenAI for report processing, transmitted via encrypted channels (HTTPS, TLS 1.2+). All transfers comply with Indian data protection laws.
Medistry employs stringent security practices including encryption (at rest and in transit), role-based access controls (RBAC) and multi-factor authentication (MFA), real-time infrastructure monitoring (AWS CloudWatch), periodic security audits, and contractual requirements for third parties to maintain ISO 27001, SOC 2, or HIPAA compliance standards.
In the event of a data breach involving protected health information, Medistry will notify affected individuals within 15 calendar days of discovery. Notifications will include a description of the breach, recommended protective steps, actions taken to mitigate harm, and contact information.
Medistry retains data only as long as necessary. Upon withdrawal of consent or explicit deletion requests, Medistry securely deletes or anonymises data within 30 days. Upon service expiry, data is deleted within 90 days unless retention is required by law.
Users have the right to decline and withhold consent, access and review collected data, correct inaccuracies, withdraw consent (subject to legal obligations), and request data deletion. To exercise these rights, contact the Grievance Officer.

By creating an account, accessing, or using any part of the Medistry application or services, you ("User") confirm that you are a registered medical professional, healthcare provider, or authorised administrative staff member affiliated with a licensed healthcare establishment in India. You agree to be bound by these Terms, the Privacy Policy, and the End User License Agreement (EULA).
These Terms form a binding agreement under the Indian Contract Act, 1872, the Information Technology Act, 2000, and the Digital Personal Data Protection Act, 2023.
Medistry provides access to a modular software platform for documentation, medical report management, and workflow automation. Modules include AI-assisted voice-to-text, structured report generation, timeline-based categorisation, analytics dashboards, patient profile auto-generation, secure patient portals, and communication interfaces.
Medistry reserves the right to update, upgrade, or discontinue features with advance notice. Trial access may be offered and is revocable at Medistry's sole discretion.
Access is granted at the Client's discretion. The Client is responsible for adding or removing Authorised Users, managing role-based access, and ensuring only trained personnel access SPDI. Medistry may suspend access upon instruction from the Client, identified violations, or failure to pay.
Users represent they are registered medical professionals or authorised staff. Users act as Data Fiduciaries and must obtain valid consent from patients before uploading data. The account holder is liable for all Authorised Users' actions and must maintain credential confidentiality.
All rights in the Platform remain with Medistry Technologies. Users receive a limited, non-exclusive, revocable licence. Users are prohibited from copying, reverse engineering, sublicensing, or using the Platform to develop competing products. Feedback submitted becomes Medistry's intellectual property.
The Platform does not provide medical advice or diagnosis. Medistry makes no warranties regarding accuracy of outputs. Users must independently verify all content. Medistry's total aggregate liability is limited to fees paid in the 30 days preceding the claim. All fees are non-refundable after trial expiration.
These Terms are governed by Indian law. Disputes shall be resolved by arbitration under the Arbitration and Conciliation Act, 1996. The seat of arbitration is Bangalore, Karnataka, India. The arbitral award is final and binding.
Medistry may amend these Terms with notice. If any provision is invalid, remaining provisions continue in force. These Terms, together with the Privacy Policy and EULA, constitute the entire agreement.

This End-User License Agreement ("EULA") governs the use of Medistry Technologies' Web Application ("Application"). By accessing or using this Application, you ("User") agree to abide by the terms herein and the Privacy Policy.
Medistry Technologies grants the User a limited, non-exclusive, non-transferable, revocable license to access and use the Application solely for medical report generation and management purposes.
By accessing the Services, you acknowledge that you have read, understood, and agree to be bound by this agreement as well as the accompanying Privacy Policy. If you do not agree, please do not use the Services.
The Application offers:
The Services must be used lawfully and in accordance with applicable laws of India. Users are solely responsible for all uploaded content and must secure explicit consent from patients before uploading data. Users are prohibited from resale, sublicensing, reverse engineering, or exploitation of the Application. Medistry shall not be liable for breaches resulting from user negligence.
All content and technology provided by Medistry Technologies is protected by intellectual property laws. You cannot modify, translate, create derivative works of, or reverse-engineer Medistry products. All rights, titles, and interests remain solely with Medistry Technologies.
Please read the Privacy Policy for all applicable data privacy standards. User data is securely encrypted and stored using MongoDB on AWS infrastructure. Users may request deletion of personal data by emailing [email protected]. Patients have view-only access and may request data deletion.
The Application does not provide medical diagnoses. Accuracy of transcription, summarisation, and insights is not guaranteed. Users must independently verify all outputs. Medistry will not be liable for indirect, incidental, special, or consequential damages. Total liability is limited to amounts paid in the month preceding the claim. The Application is provided "as is" and "as available." Upon non-renewal within six months, Medistry reserves the right to permanently delete User data. Medistry does not provide refunds for cancellation.
Users receive a one-month money-back guarantee. All payments after one month from registration are non-refundable. Monthly or yearly subscriptions are available. On failure of payment, users receive two weeks' notice before services are revoked.
Disputes shall first be attempted through mutual negotiation. Failing that, disputes shall be referred to arbitration under the Indian Arbitration and Conciliation Act, 1996. Proceedings shall be held at Bangalore, Karnataka. This Agreement is governed by the laws of India with exclusive jurisdiction in the courts of Bangalore.
Medistry Technologies reserves the right to modify this EULA. Users will be notified of significant changes via email or the Application interface. Continued use constitutes acceptance.
The Services may contain links to third-party websites or services not owned or controlled by Medistry Technologies. We do not endorse or assume responsibility for any third-party content.
If any provision is held invalid, the remaining provisions continue in full force. The parties agree to replace any invalid provision with one that most closely achieves the original intent.
